CloudRaker Acceptable Use Policy

This Acceptable Use Policy (the "AUP") forms part of the Contract Documents under the CloudRaker Terms of Service or other master agreement between CloudRaker Inc. ("CloudRaker") and the customer ("Customer") governing the Services (the "Agreement"). Capitalized terms not defined here have the meaning given in the Agreement. CloudRaker may update this AUP as provided in the Agreement. Breach of this AUP is grounds for suspension under the Agreement.

This AUP addresses conduct and content. The licence restrictions in the Agreement (including those on competing products, reverse engineering, Restricted Data and sanctioned jurisdictions) apply separately and are not limited by this AUP.

Prohibited uses

Customer shall not, and shall not permit any Authorized User, Customer End User or other person to, use the Services to:

• violate, or encourage the violation of, the legal rights of others;
• engage in, promote or encourage illegal activity, or pursue any unlawful, invasive, infringing, defamatory or fraudulent purpose, including phishing, pyramid schemes or illegally invading the privacy of others;
• upload or transmit any Customer Content that is defamatory, obscene, abusive, invasive of privacy or otherwise objectionable, including content that sexually exploits minors or depicts non-consensual sexual acts;
• interfere with any other person's use of the Services or with the equipment and infrastructure used to provide the Services, or disable, disrupt or circumvent any aspect of the Services;
• generate, distribute, publish or facilitate unsolicited mass communications of any kind, including email, SMS or voice calls, or any communication in violation of applicable anti-spam or telemarketing laws (including Canada's Anti-Spam Legislation and the CRTC Unsolicited Telecommunications Rules);
• place or facilitate calls that misrepresent the caller's identity or originating number, or record or monitor communications without the notices and consents required by applicable law;
• use any telephony or call-handling feature of the Services as a means of contacting or replacing emergency services;
• circumvent, disable or interfere with any human-approval step, guardrail, safety control or audit-logging mechanism of the Platform, including by prompt injection or similar techniques;
• perform any unauthorized access of any system, including attempting to probe, scan or test the vulnerability of a system or breach any security measure used by a system;
• place undue burden on the Services in excess of reasonable usage or any stated usage limit; or
• monitor any data or traffic on any component of the Platform without permission, or access any other CloudRaker product or service in a manner that violates the terms applicable to that product or service.

Reporting

Suspected violations of this AUP, or abuse of the Services, may be reported to abuse@cloudraker.com. CloudRaker investigates reports and may act as provided in the Agreement, including suspension.
